Employment
Peachey & Co LLP has extensive experience with all aspects of employment law, including:-
- Drafting and advising on all types of employment contracts such as part-time, agency, fixed-term, and Directors' Service Agreements;
- M&A employment related issues (including TUPE 2006 and final salary pension scheme closure/Pension Protection Fund clearance);
- Guidance on harmonisation/standardisation of terms including drafting of handbooks, policies and procedures;
- Dismissals and redundancies and all other termination of employment situations;
- Employment Contract Disputes;
- Guidance on all aspects of the latest discrimination legislation;
- Acting on behalf of both claimants and respondents in Employment Tribunal proceedings;
- Mass redundancy programmes; and
- Enforcement of restrictive covenants.
Our particular focus on mergers and acquisitions has meant that we have gained extensive experience and expertise in the areas of employment protection which affect these kinds of transactions. The mechanics of the Transfer of Undertakings Regulations 2006 or TUPE in relation to asset sales are well-known to us, not only in that context, but also in relation to its application to outsourcing and more recently service provision in both the private and public procurement sectors.
We have extensive experience of the procedure and conduct of employment tribunal proceedings not only in London but regionally and most commonly acting for respondents but also claimants too.
Similarly, we have similar expertise in the closure of final salary pension schemes and the transfer of liabilities to the Pension Protection Fund whether in a mergers and acquisitions context or in a stand alone group strategic review situation.
